The brothers who helped Jussie Smollett stage an elaborate hoax in which he claimed to be the victim of a racist and homophobic attack said they’re not surprised his conviction was overturned.

What shocks Abimbola and Olabinjo Osundairo is that the actor still won’t own up to what he did.

“We were taken back initially, not because of the Supreme Court’s decision, but because Jussie never admitted guilt,” Abimbola Osundairo told Fox News Friday. “We understand that he has due process rights and double jeopardy should not be and is not allowed in America. However, Jussie should have admitted guilt.”

Smollett has repeatedly proclaimed his innocence.

“The real injustice here was the sweetheart deal that [Smollett] was given by Kim Foxx’s office at the beginning of all of this,” Olabinjo Osundairo said.

Smollett’s conviction was thrown out on by the Illinois Supreme Court on a technicality Thursday.

The ruling rests on a decision by Cook County State’s Attorney Kim Foxx to drop the charges against Smollettt after she initially hit him with 16 felony counts pertaining to the hate crime hoax.

In a twist right out of a Netflix series, the court found the former “Empire” actor had his Fifth Amendment rights violated by a special prosecutor’s decision to try him even though initial charges against him were previously dropped.

The Osundairo brothers – who helped Smollett stage the fake attack – went on Fox News to say they can’t believe Smollett has never admitted to his lies. Fox News

Smollett, 42, who is black and gay, claimed two men in Make America Great Again hats assaulted him in the dead of night in January 2019, declaring, “This is MAGA country” before the attack.

The attackers yelled homophobic and racial slurs, put a noose around his neck and doused him with bleach, Smollett alleged — prompting a massive search for suspects by Chicago police that cost the city more than $130,000. 

Investigators quickly unraveled the elaborate ruse, revealing the actor actually hired the Osundairo brothers to stage the incident in a ploy to boost his profile and burnish his tough guy credentials.

The Osundairos also said Smollett never paid them the full amount he promised for helping him stage the hoax — then contended they didn’t do it for the cash.

“It was not about the money at all,” Abimbola said Friday. “It was more so us helping out a friend.”
