Constitutional lawyer and former federal prosecutor torches Jack Smith report on Trump: ‘Nothing more than a prosecution on paper’

Special Counsel Jack Smith’s report that concluded that Donald Trump made a “criminal effort” to overturn the 2020 election was “a partisan effort at lawfare” against the president-elect, a constitutional lawyer said.

Smith claimed in his report, released early Tuesday morning, that investigators had gathered  enough evidence to convict Trump for election interference — but were unable to bring the case to trial after Trump won the 2024 election.

Attorney Katie Cherkasky dismissed the 174-page document as “nothing more than a prosecution on paper.”

“It’s every prosecutor’s dream. You have no rebuttal, you have no cross examination. You don’t actually have to prove this case,” she told Fox News.

The long-awaited report was delivered to Congress by the Justice Department just after midnight Tuesday after a South Florida US district rejected Trump’s lawyers’ last-minute attempt to block its release late Monday.

Cherkasky noted that most of the information in the report had already been revealed to the public.

“The American people overwhelmingly voted for President Trump, knowing all of what he claims would have sustained this conviction on these unprecedented charges. So quite frankly, this is just a partisan effort at lawfare, yet again, couched in legal jargon,” she said.

Cherkasky said it was a “shame” that the report was ever released.

“I think that is just pure law fare and serves absolutely no purpose but to undermine Americans confidence in the justice system.”

Trump railed against Smith early Tuesday morning shortly after the report was released, calling the prosecutor “deranged” and a “lamebrain.”

“Jack is a lamebrain prosecutor who was unable to get his case tried before the Election, which I won in a landslide,” Trump posted on his Truth Social platform. “THE VOTERS HAVE SPOKEN!!!”
