Florida attorney general files petition against Biden vaccine requirements

TALLAHASSEE — Florida Attorney General Ashley Moody on Friday filed a formal request with a federal appeals court to review the Biden Administration’s new workplace vaccine mandate, fulfilling a threat of an all-out legal fight promised by Gov. Ron DeSantis.

What happened: Moody, a Republican, filed a petition for a review of the Occupational Safety and Health Administration rules with the 11th Circuit Court of Appeals in Atlanta, joining Alabama and Georgia in mounting legal challenges against the new vaccine requirement for businesses with more than 100 workers. Moody will follow up next week with a formal request to halt the rule from taking effect during litigation.

The Friday legal challenge includes Alabama and Georgia as plaintiffs along with six other business associations and schools. The filing asks the court to review the rule, called an emergency temporary standard, which was formalized by OSHA on Friday and will take effect Jan. 4.

Background: An ongoing war between DeSantis and President Joe Biden over Covid-19 safety standards have helped fuel talk about a possible election showdown in 2024. DeSantis’ legal challenges against the vaccine requirements will continue as state lawmakers convene for a special session in less than two weeks to consider legislation that could toughen sanctions against employers, beef up exemptions for employees and create a legal defense fund.
